  1. Notice of Collection of Use of Personal Information: WE will not collect additional categories of PERSONAL INFORMATION from any California consumer or use the PERSONAL INFORMATION of any California consumer WE collected for materially different, unrelated, or incompatible purposes without providing notice to such California consumer.
  2. Rights and Choices: The CCPA provides California consumers with specific rights regarding their PERSONAL INFORMATION. This Subsection describes your CCPA rights and explains how to exercise those rights.
    1. Right to Know and Data Portability: California consumers have the right to request that WE disclose certain information to them about our collection and use of their PERSONAL INFORMATION over the past year (the “RIGHT TO KNOW”). Once WE receive such a request and confirm the identity of the requesting California consumer, we will disclose:
      1. The categories of PERSONAL INFORMATION WE collected about the California consumer;
      2. The categories of sources for the PERSONAL INFORMATION WE collected about the California consumer;
      3. Our business or commercial purpose for collecting or selling that PERSONAL INFORMATION;
      4. The categories of third parties with whom WE share that PERSONAL INFORMATION;
      5.   3. Right to Delete:
    1. California consumers have the right to request that WE delete any of their PERSONAL INFORMATION that WE have collected and retained, subject to certain exceptions (the “RIGHT TO DELETE”). Once WE receive a request from a California consumerand confirm the identity of such consumer, WE will review the request to see if an exception allowing US to retain the information applies. WE may deny the deletion request if retaining the information is necessary for US to:
      1. Complete the transaction for which WE collected the PERSONAL INFORMATION, provide a good or service that the California consumer requested, take actions reasonably anticipated within the context of our ongoing business relationship with the California consumer, fulfill the terms of a written warranty or product recall conducted in accordance with applicable law, or otherwise perform our contract with the California consumer;
      2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
      3. Debug products to identify and repair errors that impair existing intended functionality;
      4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
      5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 and the following sections);
      6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if the California consumer previously provided informed consent;
      7. Enable solely internal uses that are reasonably aligned with consumer expectations based on the California consumer’s relationship with US;
      8. Comply with a legal obligation; and/or
      9. Make other internal and lawful uses of that information that are compatible with the context in which the California consumer provided it.
    2. Information to be Deleted: WE will delete or deidentify PERSONAL INFORMATION not subject to one of these exceptions from our records and will direct our service providers to take similar action.
    3. Exercising Your Rights to Know or Delete: To exercise your RIGHT TO KNOW or RIGHT TO DELETE described above, please contact US at the contact information located at the end of this document. Only the California consumer, or someone legally authorized to act on behalf thereof, may make a request to know or delete related to that person’s PERSONAL INFORMATION. A California consumer may also make a request to know or delete on behalf of their child. A California consumer may only submit a request to know twice within a one-year period. Such a request to know or delete must:
      1. Provide sufficient information that allows us to reasonably verify that the California consumer is the person about whom WE collected PERSONAL INFORMATION or an authorized representative; and
      2. Describe the request with sufficient detail that allows US to properly understand, evaluate, and respond to it.
    4. Response Timing and Contents: WE will confirm receipt of the request within 10 business days. If the requesting party does not receive confirmation within the 10-day timeframe, he or she may contact us via the contact information provided at the end of this document. WE endeavor to substantively respond to a verifiable consumer request within 45 days of its receipt. If WE require more time (up to another 45 days), WE will inform the requesting party of the reason and extension period in writing. Any disclosures WE provide will only cover the one-year period preceding our receipt of your request. The response WE provide will also explain the reasons WE cannot comply with a request, if applicable. For data portability requests, WE will select a format to provide the PERSONAL INFORMATION that is readily useable and should allow transmission of the information without hindrance. WE do not charge a fee to process or respond to verifiable consumer requests unless they are excessive, repetitive, or manifestly unfounded. If WE determine that the request warrants a fee, WE will tell the requesting party why we made that decision and provide a cost estimate before completing the request.
  4. Non-Discrimination: WE will not discriminate against any party for exercising any CCPA rights. Unless permitted by the CCPA, WE will not:
    1. Deny any requesting party goods or services;
    2. Charge any requesting party different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
    3. Provide any requesting party a different level or quality of goods or services; or
    4. Suggest that any requesting party may receive a different price or rate for goods or services or a different level or quality of goods or services.
  5. Financial Incentives: Notwithstanding Section Error: Reference source not found, WE may offer California consumers certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive WE offer will reasonably relate to the value of such party’s PERSONAL INFORMATION and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which a participating party may revoke at any time.

Other California Privacy Rights: California’s “Shine the Light” law (Civil Code Section 1798.83) permits users of our WEBSITE and similar platforms who are California residents to request certain information regarding our disclosure of PERSONAL INFORMATION to third parties for their direct marketing purposes.   7. Data Security: WE have implemented measures designed to secure your PERSONAL INFORMATION from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on YOU. Where WE have given YOU (or where YOU have chosen) a password for access to certain parts of our WEBSITE, YOU are responsible for keeping this password confidential. WE ask YOU not to share your password with anyone. Unfortunately, the transmission of information via the internet is not completely secure.
